The head of the Department of International Law took part in the round table "Basic paradigms in the methodology of research of modern legal systems"

The Departments of Theory and History of State and Law, International and European Law of the Faculty of Law of Kazan (Volga Region) Federal University held an international scientific round table "Basic paradigms in the methodology of research of modern legal systems" on March 24, 2023.

The round table was held in a hybrid format: face-to-face and online format on the MS Teams platform.

The purpose of the international scientific round table was to discuss and identify the characteristic features of individual methodological directions in the study of various legal spaces. To achieve this goal, the following tasks were set: identification of various methodological approaches in modern comparative law; consideration of the content of the main paradigms in the methodology of the study of modern legal systems; disclosure of the features of the interaction of legal systems.

The conference was attended by leading Russian and foreign scientists-specialists in the field of theory of state and law, international law and comparative law. Undergraduates, PhD students, and postgraduates were invited to participate in the discussion.

Two thematic sessions were held within the framework of the conference: Methodological approaches in modern comparative jurisprudence; Features of interaction of legal systems.

Bakulina, Dean of the Faculty of Law, Professor of the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, Doctor of Law, delivered a welcoming speech to the participants of the round table, professors.

The opening speech was delivered by R.S. Davletgildeev, Head of the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, Doctor of Law, Professor.

Moderators were: Davletgildeev R.Sh., Head of the Department of Theory and History of State and Law, Doctor of Law, Professor and Shigabutdinova A.L., Associate Professor of the Department of Theory and History of State and Law, Candidate of Law, Associate Professor.

Reports were delivered by: A.H. Saidov, First Deputy Speaker of the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, Director of the National Center of the Republic of Uzbekistan for Human Rights, Doctor of Law, Academician of the Academy of Sciences of the Republic of Uzbekistan, Professor. The topic of the report is "Comparative constitutionalism and constitutional reforms in the modern world".

Great interest was aroused by the report of Valery V. Lazarev, Chief Researcher of the Center for Fundamental Research of the Institute of Legislation and Comparative Law under the Government of the Russian Federation, Doctor of Law, professor on the topic "On the dislocation of judicial law in the Russian legal system".

Sergey Borisovich Zinkovsky, Associate Professor of the Department of Theory of State and Law, Acting Director of the RUDN Law Institute, PhD in Law, in his report paid attention to the cultural and historical approach to law, the historical typology of law, the characteristic features of Western and Soviet comparative studies, the paradigm of legal culture, etc.

Zakharova Maria Vladimirovna, Head of the REC of Comparative Law of the Kutafin Moscow State Law University (MSLA), Doctor of Law, Corresponding Member of the International Academy of Comparative Law, Doctor of Public Law (France), Visiting Professor at the University of Poitiers (France) with the report "Rules of exceptions as methodological tools in various legal systems peace."

Gubaidullin Aidar Rushanovich, Associate Professor of the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, Candidate of Law, Associate Professor made a report "The role of concepts of legal understanding in the study of legal systems." In it, he focused on the aspects of the normative component of Russian law, the factors of an expanded understanding of law.

Pogodin Alexander Vitalievich, Professor of the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, Doctor of Law, Professor in the report "The structure of the legal system of the Russian Federation: theory and practice" revealed the phases of development of the legal system, levels and issues of the structure of the legal system, etc.

Trikoz Elena Nikolaevna, Associate Professor of the International Law Faculty of MGIMO of the Ministry of Foreign Affairs of Russia; Associate Professor of the RUDN Law Institute, Candidate of Law, Associate Professor in the report "Codification in the mixed legal systems of the British Empire: the Criminal Code of Transkei and the Criminal Code of Ranbir" spoke about the effect of the customary legal norms of indigenous peoples and Roman-Dutch law on the territory of the East and West coast Of the Republic of South Africa.

The problems of methodology of interaction of legal systems were highlighted by R.S. Davletgildeev, Head of the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, Doctor of Law, Professor.

Dmitry Y. Poldnikov, Professor of the Department of Theory of Law and Comparative Law of the National Research University Higher School of Economics, Doctor of Law, made a report "Legal systems in the mirror of legal traditions". Being a legal historian, he drew attention to the culturological approach in the study of law, the history of the state and law, the concept of legal tradition, etc.

Valeriya V. Kurnosova, Associate Professor of the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, PhD in Law. Her report was called "Legal instruments for the convergence of legal and economic systems."

Krasnov Eduard Vladimirovich, Senior lecturer at the Department of Theory and History of State and Law of Kazan (Volga Region) Federal University, PhD in Law in the report "Comparative legal analysis of the features of building a rule of law in the Russian Federation and the Republic of Kazakhstan" outlined, along with other issues, an analysis of the activities of the Parliament, the APK, the Constitutional Council; issues of administrative and territorial division Kazakhstan.

Tlepina Sholpan Valeryevna, Doctor of Law, Professor, Head of the Department of International Law of the L.N. Gumilyov Eurasian National University with a report on the interaction of international law and comparative jurisprudence. The report concluded that the comparative approach makes it possible to identify those international legal developments, elements, phenomena that, by virtue of their essence and regulatory nature, are common to all legal civilizations and cultures; the comparative legal method of studying international law and its history should consist in finding out what is common and what is different among several legal cultures and civilizations, without recognizing the priority or greater progressiveness of one of them, etc.
