Busurmanov Zhumabek Dyuseshevich

A well-known lawyer, human rights activist, doctor of law, Professor, ex-member of the constitutional Council of the Republic of Kazakhstan.

In 1994, the Head of state appointed Zh. d. Busurmanov as Secretary of the Commission on human rights under the President of the Republic of Kazakhstan. Subsequently, he was the head of the Secretariat, the first Deputy Chairman of this Commission, and a member of the pardon Commission under the President of the Republic of Kazakhstan. Zh. d. Busurmanov visited many countries in Europe and Asia, met with world-famous human rights defenders, spoke at various international forums organized by the UN and OSCE in Geneva, Brussels, Warsaw, Budapest, Kiev, Moscow, Riga, Tashkent, Ashgabat, Bishkek, etc. He is one of the first developers of the idea of establishing an Ombudsman institution in Kazakhstan, a draft State program in the field of human rights, and the first official annual reports on the state of human and civil rights and freedoms in Kazakhstan.

In 1998 the decree of the President of the Republic of Kazakhstan he was appointed in 2001 and 2005, for his significant contribution to the development and formation of statehood, strengthening the sovereignty of the Republic, and also to commemorate the 10 anniversary of independence of the Republic of Kazakhstan and the 10th anniversary of the Constitution of the Republic of Kazakhstan he was awarded medals "10 years of independence of the Republic of Kazakhstan" and "10 years of Constitution of the Republic of Kazakhstan".

Zhumabek Dyuseshevich Busurmanov was a Member of the constitutional Council of the Republic of Kazakhstan from 06.03.1998 to 20.02.2002.

According to Zh. d. Busurmanov, the constitutional Council of the Republic of Kazakhstan is a body of indirect protection of human and civil rights. The rights of citizens of our state can be protected in the constitutional Council not directly, but "through the courts of General jurisdiction". Paragraph 2 of article 72 of the Constitution of the Republic of Kazakhstan contains the basis for applying to the constitutional Council of the courts. As Zh. d. Busurmanov notes, the removal of an unconstitutional legal act "from the legal system in order to neutralize citizens from the negative legal impact. As a result, the decision of the constitutional Council satisfies the interests of not one, but a large circle of citizens who are parties to similar legal relations or possible in the future."

The constitutional Council's influence on the formation of theoretical aspects of Kazakhstan's concept of human and civil rights is undeniable, since the doctrinal interpretation of the Constitution's norms by members of the constitutional Council for improving legislation is given based on the analysis of the effect of the legislation's norms in practice. In addition, the formation of a national concept of human rights is impossible without the formation of a person's faith in the real operation of the Constitution, the protection of their rights and freedoms. One of the ways to achieve this goal is to inform the population about the state of constitutional legality in the Republic through the annual Messages of the constitutional Council.

Members of the Department of International law exchanged views, recalled historical facts from the life of the country and the adoption of the Constitution of the Republic of Kazakhstan, which was informative for young professionals.
