Scientific and practical conference "The Role and Place of International Law in the Solution of Contemporary Global Problems"

 

On the 22nd of December 2017 the official opening of the international scientific and practical conference "The Role and Place of International Law in the Solution of Contemporary Global Problems" was held, it was dedicated to the 70th anniversary of the first Doctor of Science in International Law, member of the Central Election Commission, Doctor of Law, Professor Marat Aldangorovich Sarsembayev . N. Gumilyov ENU Abaideldinov E.M., Head of the International Law Department, Doctor of Law, Professor Tlepina Sh.V., Head of the Department of International Legislation and Comparative Law of the Institute of Legislation of the Republic of Kazakhstan Abylayuly A.

The organizer of the conference was the L.N. Gumilyov Eurasian National University, in particular, the Department of International Law of the Law Faculty.

Within the framework of the conference, a session of sections devoted to various contemporary problems of International Law was held. The conference was attended by more than 50 people, including foreign and leading Kazakhstani scientists, representatives of universities, government agencies, ministries and departments. However, the meeting of the sections was aimed at developing the research skills of the students, motivating their further participation in research activities. Thus, within the framework of the conference there was a competition of scientific works among the students in the nominations "for scientific novelty", "for creative approach", "for an unordinary approach" and "for creativity". The awarding of the letters will be held the next day on December 23, where the winner will be the jubilee himself Marat Aldangorovich Sarsembayev.

Participants of the conference, who worked in the first section "International and National Law: Challenges of the 21st Century and Crisis in Mutual Confidence", focused their attention on the problems of interaction between international and national law.

Within the framework of the sectional meeting, the following issues were discussed: the interaction of international legal norms and national legislation of countries participating in an international treaty; questions of the carrier's liability for loss and damage to luggage under an international passenger air transport contract; the correlation between the norms of international law and Kazakhstan's legislation in the field of ensuring the voting rights of convicts; development of Kazakhstan's tax legislation in the context of globalization; international legal protection of personal data; international labor standards and their reflection in the labor legislation of the EEU countries.

The participants of the section emphasized that in the 21st century, in the context of the globalization of new threats and challenges to humanity, the international community continues to make provision for universal (international) peace, security and sustainable development as the main task of International Law. Numerous international legal documents continue to combat threats and challenges to peace and security, ensure stable and crisis-proof development.

The participants of the section note the following problems of interaction between international and national law: state sovereignty and international law; interference by the international community in the affairs of sovereign states; the principles of the territorial integrity of states and the right of nations to self-determination; unconstitutional change of state power; the global economic crisis as a result of a violation of the rule of law; the adequacy of legal methods in the era of crisis; the failure of the idea of ​​multiculturalism; the threat of chaotization of international law; risk for the stability of national law and order, etc.

Participants of the conference who worked in the second section "The Law of Regional International Organizations: Development Trends" made presentations on various topical issues within the framework of the section. Participants included a wide range of issues related to international law and the role of international law in solving contemporary problems. The presented reports reflected the issues of legal integration of countries in the global world, examples of positive experience of the development of regional integration associations were cited.

The participants of the third section on the topic: "Actual problems of improving the legislation of the Republic of Kazakhstan in the conditions of the functioning of integration associations", focused their attention on the problems of applying and improving the legislation of the Republic of Kazakhstan with Kazakhstan's active participation in integration associations.

Within the framework of the sectional meeting, the following issues were discussed: control powers of maslikhats in the Republic of Kazakhstan, application of the norms of international treaties in state bodies and courts of the Republic of Kazakhstan, influence of the EAEC right to subordinate lawmaking of the Republic of Kazakhstan, issues of management activity in the sphere of environmental protection, participation of the Republic of Kazakhstan in The Hague conference on private international law and prospects for improving the legislation of the Republic of Kazakhstan, the issue of language qualifications in voters for legislation of the Republic of Kazakhstan, the problems and prospects for improving the field of business taxation in the Member States EAEC, means of resolving property disputes in the European Union, gender equality and its place in the Kazakhstan legislation and many others.

Participants in the fourth section on "UN treaty bodies in the system of human rights protection" made presentations on such topics as the activities of UN bodies, the protection of human rights in armed conflicts, the protection of women's rights at the national and international levels, the protection of the rights of children, the rights of migrants, diplomatic and consular protection, non-governmental organizations for the protection of human rights and many others.

Within the framework of the fifth section on the topic "Development of international legal education in the Republic of Kazakhstan and foreign countries", the problematic issues of modernization of the higher education system in connection with the integrated national system in the European space, as well as the issues of reforming the education system in Kazakhstan and others were discussed.

The participants of the conference noted the huge contribution of M. A. Sarsembayev to the development of international law, not only in Kazakhstan, but throughout the Central Asian region; positive trends in the development of international law in the integration processes; timeliness and relevance of the conference.

During the speeches, the participants of the sections also noted the following provisions that the Republic of Kazakhstan actively participates in integration processes, contributes to more effective neutralization of challenges and threats in the sphere of national and regional security, the development of mutually beneficial trade and economic ties, and maintaining the balance of forces in the face of growing rivalry between leading states.
