Criminological Forum on the topic "Suspect and Accused: Are Their Rights Really Protected?"

 December 14, 2017 in the L.N. Gumilyov Eurasian National University, together with the Academy of Law Enforcement Agencies under the General Prosecutor's Office of the Republic of Kazakhstan, held a Criminological Forum on the topic "Suspect and Accused: Are Their Rights Really Protected?".

Organizers: Department of Criminal Law Disciplines of the Law Faculty of the L.N. Gumilyov Eurasian National University and the Interdepartmental Research Institute of the Academy.

The forum was attended by national and foreign experts Shepeleva Larisa Arkadievna, judge of the Judicial Board of Criminal Cases of the Supreme Court of the Republic of Kazakhstan, Akhpanov Arstan Nokeshevich, Professor of the Department of Criminal Legal Disciplines of the L.N. Gumilyov Eurasian National University, Doctor of Law, Professor, Pen Sergey Gennadievich, Director of the Higher School of Law of KazGYU, Candidate of Legal Sciences, Associate Professor, Meishvili Zaza, International Expert, Georgia, Vitaly Ivanovich Voronov, Advocate of the Almaty City Bar Association, Practitioners, employees, students and undergraduates.

Dean of the Faculty of Law, Doctor of Law, Professor Amandykova S.K. and Acting Rector of the Academy Ahmetzakirov N.R. made a welcoming speech.

The forum was devoted to the problems of ensuring the rights of citizens involved in the orbit of criminal prosecution. Deputies of the Parliament, heads of law enforcement bodies, representatives of the scientific and legal community, non-governmental organizations, international and national experts took part in the discussion of topical issues on the agenda.

As noted by the speakers, consistent measures are being taken in Kazakhstan to create an effective mechanism for the protection of human rights and freedoms. Legislative and practical innovations are aimed at strengthening the rule of law in the criminal legal sphere, enhancing the capacity of citizens to protect their rights.

The other day the Head of State signed the Law of the Republic of Kazakhstan aimed at further modernizing the criminal process in the context of strengthening the protection of human rights and increasing the adversarial nature of the parties, simplifying the procedure for investigation.

At the same time, the issues of effective protection of the rights of the suspect and the accused remain one of the urgent problems of the criminal process. It is here that the fundamental rights and freedoms are sharply affected and infringed. Despite the current legislative mechanisms, in practice, the requirements of the law are not always respected.

As a result of the discussions, taking into account the views of all interested parties, the organizers of the forum developed recommendations containing a set of legal and practical initiatives aimed at strengthening the rule of law, ensuring the legitimate rights of suspects and accused.
